Good Practice Guide to Landlord and Tenant Matters
This guide will give Science Park Managers and others involved in Science Parks a basic background into the mysterious world of landlord and tenant. It will help them understand the terminology used by solicitors and property professionals, the matters to consider when granting leases and licenses, both of a legal and practical nature and what to take into account when proposing terms of occupancy.
It should not be used as a substitute for independent professional advice, whether of a legal or property related nature and is merely intended to assist discussions with appointed property professionals.
Emphasis will be placed upon the uniqueness of each property asset and that the guide is designed to assist with making informed decisions.
This guide is intended to deal with the legislation covering short-term business leases and licenses in England and Wales and not long leases. Short-term leases in this context will generally mean leases for terms up to 25 years, where the landlord has constructed the building and has not granted a lease of land where the tenant has then built a property to their own requirements. The guide will not deal with any matters relating to residential occupation, other than where this may be ancillary to the main business occupation.
The legal references also refer to the law in England and Wales only. Scottish property law differs substantially and no reference is made to corresponding Scottish legislation in this guide.
